EU AI Act and Pharmaceutical Companies: What You Need to Know in 2026

The EU AI Act is now enforceable. Many pharma AI systems are classified as "high-risk." Here's the practical compliance roadmap — not the consultant version with 40-page policy documents.

The EU AI Act became fully enforceable in 2026. If your pharmaceutical or biotech company operates in Europe — or sells products there — you're in scope.

The good news: Most of what the EU AI Act requires overlaps with existing GxP regulations. If you're already compliant with 21 CFR Part 11, EU Annex 11, and ICH quality guidelines, you're 60-70% of the way there.

    EU AI Act Article 9: High-risk AI must have a risk management system throughout the AI lifecycle.

  • Maintain data lineage (from raw data sources → preprocessed datasets → model versions)

    EU AI Act Article 12: High-risk AI must automatically log:

  • Operations and events during the AI's lifecycle
  • Periods when the AI is in use
  • Database queries and inputs used by the AI
  • Persons who access or use the AI

  • Model versioning in logs: Can you prove which model version was used for a specific decision?
  • Automated logging: Is logging automatic (not dependent on users remembering to document)?

    EU AI Act Article 13: Users must be informed that they're interacting with an AI system, and must be provided with:

  • Information about the AI's capabilities and limitations
  • Instructions for proper use
  • Expected level of accuracy and robustness

  • GxP requires trained users, but doesn't explicitly require AI-specific transparency
  • EU AI Act requires clear disclosure that AI is being used and explainability of AI outputs

  • Output explainability: When the AI flags something, can the user see why? (e.g., "This deviation was flagged because it matches 12 prior cases with similar characteristics")
  • Override mechanisms: Can users override AI recommendations and document their rationale?

  • Label AI-generated outputs clearly (e.g., "AI-assisted classification," "AI-generated narrative draft")
  • Provide explainability features (show key factors that influenced the AI's recommendation)

    EU AI Act Article 15: High-risk AI must achieve an appropriate level of:

  • Accuracy (performs as intended across expected conditions)
